Right of withdrawal

Are you a consumer and have you engaged VanIersel Development for a service (for example, website development, consulting, or a landing page)? You generally have a 14-day cooling-off period during which you may withdraw from the contract free of charge. This page explains how and lets you download the model form.

1. Statutory 14-day cooling-off period

Under Article 6:230o of the Dutch Civil Code (implementing EU Directive 2011/83/EU) you have 14 days from the conclusion of the contract to withdraw without giving a reason. This applies to distance contracts for the supply of services or digital products.

The right of withdrawal applies only to B2C contracts (consumer as client). For B2B commissions (sole trader/SME, legal entity), the statutory cooling-off period does not apply - the terms in the quote/contract govern.

2. Waiver upon immediate performance (art. 6:230p BW)

For most development engagements I request explicit consent to begin work within the cooling-off period. If you provide this consent and explicitly waive your right of withdrawal, that right expires once the service has been fully performed.

Without explicit consent, you keep the full 14 days. In that case, work will start only after those 14 days have passed, unless you agree to start sooner.

3. How to withdraw

Download the model form at the bottom of this page, fill in your details, and send it by e-mail to [email protected]. A free-form statement ("I hereby withdraw from the contract of [date] concerning [engagement]") is also legally valid.

I acknowledge receipt within 2 business days and process the withdrawal free of charge.

4. Consequences of withdrawal

Upon valid withdrawal I refund paid amounts without undue delay and no later than within 14 days, using the same payment method as the original transaction.

If you explicitly waived your right of withdrawal at commissioning and work has been wholly or partly performed, I may charge pro-rata for the work already delivered under Article 6:230s(5) BW.
